Terms and Conditions

These general terms and conditions (the "Terms") of evobeds s.r.o., with its registered office at Paličkova 75/2, Ostrava, Nová Ves, 709 00, Company ID 07754523 ("evobeds s.r.o." or "we"), govern, in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Czech Civil Code, the mutual rights and obligations of the parties arising in connection with or on the basis of a purchase contract concluded between us and consumers or businesses (the "customer" or "you") through our online store.

Where an international element is present, we agree that the legal relationship between us shall be governed by the law of the Czech Republic, in particular the Civil Code. In accordance with Article 3 of Regulation (EC) No 593/2008 of the European Parliament and of the Council on the law applicable to contractual obligations, this choice of law shall not deprive a consumer of the protection afforded by the provisions of the law of the country of their habitual residence.

A consumer is any natural person who concludes a purchase contract with us, or otherwise legally deals with us, outside the scope of their business activity or the independent exercise of their profession.

A business is any natural or legal person who independently carries out gainful activity on their own account and responsibility with the intention of doing so consistently for profit. We follow the principle that for a customer who selects company details in the order and provides their Company ID, or VAT ID, the provisions of these Terms applicable to businesses apply.

By submitting an order the customer confirms that they have read the Terms, including the information for consumers provided before the conclusion of the purchase contract, and expressly agrees with them in the wording valid and effective at the moment of confirmation.

1. Registration and login

1.1 No registration is required in our e-shop.

1.2 You fill in all the details needed for shipping, invoicing and possible phone contact during checkout.

2. Shopping

2.1 Choose your goods, read the description, look at the photos, select the desired configuration and continue with your purchase.

2.2 You can review and edit the contents of your order before submitting it.

2.3 Next, you choose the delivery method.

2.4 Then you fill in your contact and billing details.

2.5 Please review your order before submitting it.

2.6 We reserve the right to refuse an order, for example when it is placed by a customer who has previously failed to collect a shipment or has had an unpaid obligation towards evobeds s.r.o. or our partner company Invira s.r.o., or when the customer provides untrue or meaningless information.

2.7 The ordered goods may occasionally be out of stock. We will inform you of this as soon as possible and let you know when they will be available.

2.8 If you are interested in goods that are not listed in our catalogue, contact us at [email protected].

3. Delivery

3.1 Shipments are delivered by PPL and DHL with payment on delivery, payment in advance based on a proforma invoice, or payment via the payment gateway.

3.2 We hand shipments over to the carrier as soon as possible. You can enquire about a specific delivery by phone.

3.3 Payment is made on delivery, in advance based on a proforma invoice, or via the payment gateway.

3.4 Delivery prices are set according to the price list below. Oversized goods, meaning beds, are delivered by our own transport or by a haulage company.

3.5 Packaging is included in the delivery price.

4. Complaints and warranty claims

All new goods are covered by a 24 month period for exercising rights arising from defects. evobeds s.r.o. does not cover the cost of transporting goods for a warranty claim.

4.1 Complaint proceedings are governed by the rules set out in the applicable laws of the Czech Republic.

4.2 Standard complaint proceedings take 30 days from receipt of the shipment to dispatch of the shipment together with notification of the outcome. Your goods may be repaired or replaced, your money may be refunded to your bank account, or the claim may be rejected.

4.3 Always submit a claim immediately after a defect appears. Late claims may not be taken into account.

4.4 We reserve the right to replace defective or irreparable goods with other goods of the same parameters.

4.6 If a product is damaged in transit, the customer must duly prove this, for example by sending a photograph or a damage report drawn up with the carrier. Damage caused by transport is settled by the transport company. It is therefore necessary not to accept a damaged parcel from the carrier, or to make a detailed description of the damage and have it signed by the carrier.

4.7 Goods in transit are duly insured for the set value.

Returning goods within 14 days

4.8 By law, you have the right to return goods purchased online to the seller within 14 days under clearly defined conditions:

• The goods must be complete, unused and undamaged, fit for resale. If any of these conditions is not met, the seller is entitled to charge the consumer for remedying it, and the refunded portion of the purchase price will be reduced accordingly.
• Send the goods no later than 14 days after receiving them.
• A copy of our tax document must be enclosed with the returned shipment.
• We refund the price of the goods, not the postage you paid.
• Always inform us about the return at [email protected].
• Never send goods cash on delivery, such shipments will not be accepted. The buyer pays the postage for returning the product.
• The money will be transferred to the buyer's bank account no later than seven working days after we receive the returned goods.
• For refurbished or used goods, rights arising from defects upon receipt can be exercised for a maximum of 1 year.

5. Data protection

5.1 By filling in your details in our online store you consent to the collection and processing of certain personal data and information about your purchases and orders. We use this data exclusively for the company's internal needs, customer identification, improving our cooperation and handling claims. It is never passed on to third parties. 7. Dispute resolution

7.1 All disputes between us and the customer will be resolved amicably. If the parties fail to reach an agreement, the dispute will be decided by the general court having jurisdiction over the registered office of evobeds s.r.o.

7.2 Consumers also have the right to out-of-court dispute resolution. The body for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority, Štěpánská 567/15, 120 00 Praha 2, www.coi.cz.

7.3 Consumers may also use the online dispute resolution platform established by the European Commission at ec.europa.eu/consumers/odr.
